1. Acceptance of Terms

By using this website or buying from Cairé Roasters, you agree to be bound by these Terms of Service. If you do not agree to all of them, you may not use the website or our services. We may update these Terms at any time, as described in Section 15.

2. Eligibility

You must be at least 18, or the age of legal majority where you live, to use this website and place orders. By using the website, you represent and warrant that you meet this requirement.

3. Account and Ordering

When you order, you agree to give accurate, current, and complete information, including your name, shipping address, email address, and payment details. You are responsible for keeping any account credentials confidential.

All orders are subject to acceptance and availability. We may refuse or cancel any order for any reason, including but not limited to availability, errors in product or pricing information, or suspected fraud.

4. Pricing and Payment

All prices are in US dollars (USD) and may change without notice. We work to keep prices accurate, but errors can happen; if one does, we may cancel the order and refund it in full.

Payments are processed securely by Stripe, Inc. We do not store your full card number, expiration date, or CVV on our servers. By submitting your payment information, you authorize Stripe to charge the applicable amount. All transactions are encrypted and handled in line with PCI-DSS standards.

Applicable sales tax is calculated and added at checkout, based on your shipping address and state and local tax law.

5. Shipping Policy

We ship within the United States only. Coffee is roasted to order in Oregon and ships within 1 to 3 business days. Prints, glasses, mugs and stickers are made to order and ship separately, so an order with both arrives in two parcels with two tracking numbers. Delivery times vary by location.

Standard shipping is free on orders of $40 or more before tax. On smaller orders, the shipping fee is shown at checkout. A Ordem always ships free.

Risk of loss and title for items purchased pass to you when we deliver the items to the carrier. We are not responsible for delays caused by the carrier, weather, or other circumstances beyond our control.

Even so, we replace items that arrive damaged, misprinted or wrong, items that are missing, and parcels that are lost in transit, as set out in Section 6 of our Refund & Return Policy: tell us within 14 days of delivery, with your order number and a photo of the item and its packaging.

6. Returns and Refunds

Returns and refunds are set out in our Refund & Return Policy. By placing an order, you agree to that policy.

7. A Ordem (Subscriptions)

A Ordem ($29) and A Ordem + Copo ($54) are recurring plans. By joining, you authorize us to charge your payment method the plan price every 29 days (one moon) until you cancel. The Full Cycle ($399) is charged once, ships eight times, one moon apart, and ends by itself after the eighth shipment.

You may cancel at any time from the link in your receipt email, or by writing to us at [email protected]. Recurring plans stop before the next moon is billed. A moon already billed has already shipped and is not refunded, unless it arrives damaged, wrong or missing. If you cancel the Full Cycle before the first moon ships, we refund it in full; after that, cancelling stops the moons not yet shipped and refunds $399 minus $54 for each moon already shipped, to your original payment method, automatically. Section 9 of our Refund & Return Policy sets out the amounts.

Membership perks. While you have an active A Ordem membership, on any plan, every moon ships free and you get first pour: products we mark as members-first can be bought only by members, and by Mestres, until the date shown. Finishing a cycle, meaning eight moons in a row on one membership (the Full Cycle reaches it on its eighth moon), makes you a Mestre. A Mestre gets 10% off everything in the shop and first pour for life, and only Mestres may buy the Lua Azul glass. Mestre status stays after you leave A Ordem. Cancelling the Full Cycle early means you do not become a Mestre.

How perks are applied. There is no account login. Perks are applied at checkout from the email address you enter in the cart, which must be the one you joined A Ordem with; an order that uses a perk is attached to that membership, and its receipt goes to that address. Mestre status and its perks are personal to the person who earned them and may not be sold, transferred or shared. The Mestre discount cannot be combined with other discount codes or promotions. We may refuse or cancel an order that uses a perk it is not entitled to.

We may change A Ordem prices with at least 14 days' notice sent to the email address on file. We may change or end membership and Mestre perks with notice on this website or by email; a change does not affect orders already placed.

8. Intellectual Property

All content on this website, including but not limited to text, graphics, cordel-style illustrations, woodcut artwork, logos, product names, brand identity, photographs, and software, is the property of Cairé Roasters or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this website without our prior written consent. Limited personal, non-commercial use (such as sharing a product link) is permitted provided you include proper attribution.

9. Prohibited Conduct

You agree not to:

• Use the website for any unlawful purpose or in violation of any applicable law
• Interfere with or disrupt the website, servers, or networks connected to the website
• Attempt to gain unauthorized access to any part of the website or its related systems
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the website without our written permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Submit false or misleading information when placing orders

10. Disclaimer of Warranties

THE WEBSITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the website will be uninterrupted, secure, or error-free, or that any defects will be corrected. Coffee is a natural agricultural product, and minor variations in flavor, color, and aroma between batches are normal and expected.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAIRÉ ROASTERS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR PURCHASE OF OUR PRODUCTS, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE WEBSITE OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cairé Roasters and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the website, violation of these Terms, or infringement of any intellectual property or other right of any third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or your use of the website shall be resolved exclusively in the state or federal courts located in the State of Oregon. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

15. Changes to These Terms

We may revise these Terms at any time by updating this page; the “Last Updated” date at the top shows when. We will announce material changes on the website or by email. Your continued use of the website after any change means you accept the revised Terms.
